Since September 1, 2024, new requirements for foreign specialists have been in force in France, strengthening control over their employment. Now, when applying for a work permit, all parties will be taken into account: the employer, the employee and the company hosting the employee.
According to the new provisions, the employer is exempt from criminal and administrative liability if he provided assistance to an employee who violated the laws of entry or stay in the country, as well as for using false documents or causing damage to third parties.
What are the rules for extending a work permit
There are a number of requirements for extending a work permit in France. They must be observed in order to avoid fines or rejection.
Here are the basic conditions:
- Legal stay in the country: it is necessary that the work permit is valid at the time of applying for an extension.
- Compliance with the terms of the employment contract: the employee must continue to work under the same employment contract and under the same conditions that were approved at the first receipt of the permit. Changes in working conditions: for example, a change of position, salary or employer, require a review of the permit.
- The extension is 2 months before the end of the term.
- Proof of employment: the employer must provide compliance with all tax and social obligations related to the employment of the relocator.
- The economic condition of the employer: it is important that he is in good financial condition and can continue to provide the hired employee with appropriate conditions.
- No violations of labor laws: for example, illegal work or violation of the conditions of the permit.
Penalties for violations of the extension rules
Since the requirements for renewal remain the same, additional conditions apply to employees of apprenticeship status whose employers are located outside France. In this case, the receiving organization is obliged to ensure the legal registration of an employment permit.
List of reasons:
- Late extension: if the application is submitted late, there may be problems with its approval, and there is also a risk of administrative sanctions.
- Illegal work: if an employee continues to work without a valid permit, the employer will be fined more than 20,000 €.
- Fines for refusal of renewal: if the extension application is rejected due to non-compliance, an additional fine of up to 20,750 € per employee may be imposed.
Failure to comply with the requirements may entail not only administrative fines, but also a ban on further employment in the country.
